The Bizz Traders User Agreement

 

This User Agreement ("Agreement") is a legal contract between you ("User" or "you") and The Bizz Traders ("Company", "we", "us", or "our") governing your use of The Bizz Traders' services, websites, applications, and any associated content, features, or functionality (collectively, the "Services"). By accessing or using the Services, you agree to be bound by the terms and conditions of this Agreement.

By accessing or using the Services, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to all the terms and conditions of this Agreement, you may not access or use the Services.

3. Investment Risks

 

3.1. No Investment Advice: The information provided by The Bizz Traders is for informational purposes only and should not be construed as investment advice. You are solely responsible for making your own investment decisions.

 

3.2. Risks: Investing in stocks involves risks, including the risk of loss of capital. You acknowledge and agree that The Bizz Traders shall not be liable for any losses or damages incurred as a result of your investment decisions.

 

3.3. Volatility: Stock prices can be highly volatile and may fluctuate significantly in a short period of time. You acknowledge and agree that The Bizz Traders shall not be liable for any losses or damages resulting from market volatility.

4. User Conduct

 

4.1. Compliance: You agree to use the Services in compliance with all applicable laws, regulations, and this Agreement. You shall not engage in any conduct that violates the rights of others or that is harmful, offensive, or objectionable.

 

4.2. Prohibited Activities: You shall not engage in any of the following activities:

 

   a. Manipulating stock prices or engaging in insider trading.

   

   b. Using the Services for fraudulent or illegal purposes.

   

   c. Interfering with the operation of the Services or disrupting the experience of other users.

 

4.3. Professional Advice: You acknowledge and agree that The Bizz Traders does not provide legal, tax, or financial advice. You should consult with a qualified professional before making any investment decisions.

5. Privacy

 

5.1. Privacy Policy: Your use of the Services is subject to The Bizz Traders' Privacy Policy, which is incorporated into this Agreement by reference. By using the Services, you consent to the collection and use of your information in accordance with the Privacy Policy.

 

5.2. Data Security: The Bizz Traders employ reasonable measures to protect the security of your information. However, you acknowledge and agree that no data transmission over the internet or method of electronic storage is completely secure.

6. Termination

 

6.1. Termination by Company: The Bizz Traders may suspend or terminate your access to the Services at any time for any reason without prior notice or liability.

 

6.2. Termination by User: You may terminate this Agreement by discontinuing your use of the Services and closing your account.

 

6.3. Survival: Sections 3, 4, 5, 7, 8, 9, and 10 shall survive any termination or expiration of this Agreement.

7. Disclaimer of Warranties

 

THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, THE BIZZ TRADERS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

 

IN NO EVENT SHALL THE BIZZ TRADERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES OR THIS AGREEMENT, EVEN IF THE BIZZ TRADERS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

 

You agree to indemnify, defend, and hold harmless The Bizz Traders and its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or in connection with your use of the Services, your violation of this Agreement, or your violation of any rights of another party.

10. Governing Law and Dispute Resolution

12.2. Information Accuracy: You agree to provide accurate and complete information when using the Services, including when creating your account, submitting orders, and providing payment information.

 

12.3. Compliance with Regulations: You agree to comply with all applicable laws, regulations, and rules governing securities trading, including but not limited to the Securities Act of 1933, the Securities Exchange Act of 1934, and the rules of the Securities and Exchange Commission (SEC) and any self-regulatory organisations (SROs) such as the Financial Industry Regulatory Authority (FINRA).

13. Intellectual Property Rights

 

13.1. Ownership: The Bizz Traders retains all right, title, and interest in and to the Services, including all intellectual property rights therein. You acknowledge and agree that the Services and any related materials are protected by copyright, trademark, and other laws.

 

13.2. Licence: Subject to your compliance with this Agreement, The Bizz Traders grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal or internal business purposes.

14.1. Third-Party Content: The Services may include content provided by third parties, including but not limited to news articles, research reports, and market analysis. 14.2. Links to Third-Party Sites: The Services may contain links to third-party websites or resources. The Bizz Traders is not responsible for the availability or content of such websites or resources and shall not be liable for any damages or losses arising from your use of or reliance on any third-party website or resource.

No Consequential Damages: In no event shall The Bizz Traders be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data, whether incurred directly or indirectly, arising out of or in connection with your use of the Services or this Agreement, even if The Bizz Traders has been advised of the possibility of such damages.

 

17.2. Limitation of Liability: In no event shall the aggregate liability of The Bizz Traders arising out of or in connection with this Agreement exceed the amount paid by you to The Bizz Traders in the twelve-month period preceding the event giving rise to such liability.

If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions of this Agreement shall remain in full force and effect to the fullest extent permitted by law.

This Agreement constitutes the entire agreement between you and The Bizz Traders regarding your use of the Services and supersedes all prior or contemporaneous understandings and agreements, whether oral or written, between you and The Bizz Traders.
